I think we can all agree that there are SOME bad cops out there, same as there are bad apples in every bunch. But we should be careful to use a narrow brush when painting them, and those on the other side might try to not take remarks about the bad cops personally. I am quite sure that the LEO family here do not fall into the bad cop category.

As I said, we know that every single time an LEO leaves his/her home, they don't know if they will be returning. We know they deal with the scum of the earth every day and that they get sick of it. BUT WE ARE NOT THE ENEMY. We're just looking for an honest discussion of something we view as wrong.
That's because that is what they deal with, day in, day out. They go to work every day to be lied to, called names, and have their every move scrutinized by the public. It happens every.single.day.on.the.job. Does anyone else here know how they would react to this?

I am sure good, honest, cops would love nothing more than to separate themselves from the not so good, dishonest cops. BUT, because they all wear uniforms, work together, and are often seen as "one" to the public eye, they get unfair judgement of "they're all alike". I don't see a cop and wonder why he's defensive. I see a cop and say "no wonder he's defensive". They have to be defensive. They are targets in every aspect a human can be a target...just because of their job.

Back to the topic. Yes, there is room for cops to abuse the laws they are supposed to enforce. It happens. Yes, there are entire jurisdictions that abuse their positions in law enforcement.

I think any cop seizing money, without proper PC of said money being related to a crime, is abusing his position. Any jurisdiction that does this habitually needs to be cleaned out. Period. If a cop has a history of not being able to make sound cases, and people are hurt because of those actions, he needs to be dealt with however is appropriate (re-trained, written up, fired, whatever the situation merits).
 
Firstly, while I am sure to the bone that neither Winchester or GC would do such a thing unless directly ordered to do so, and that neither has personally witnessed abuses, the allegation that it doesn't happen is absolutely ludicrous. Pick up a newspaper or watch the evening news. It happens somewhere every day.

Thirdly, you guys may think that Cobb's nose is completely clean, but it isn't. While there have been no substantiated cased of theft, Cobb has been accused of and admitted to being in violation of Georgia Statutes, § 16-13-49(u)(4)(c)(iii). This is the part of the Forfeiture law that requires an annual reporting of all assets seized and the disposition of those assets. Cobb, along with most other Georgia counties, quite simply does not do this. Cobb was completely unable to respond to a FOI request for that information, because, in their words, the information did not exist. Through forensic accounting (unaudited) they were able to partially account for the cash and property. The result is that this money easily becomes nothing but a slush fund, completely off the books and ripe for abuse. In fact, Douglas County has used their fund for parties, gifts, and personal trips. There is no proof that Cobb has misused the funds, but there is absolutely no way to tell since they themselves don't know where it all went. Without a whistle blower, we will probably never know. I would like to believe that it was just an oversight on their part, I guess we will know next year when they do or do not file the required report.

The short answer is this. The burden of proof should always be on the government to prove the guilt of a citizen. The clown act of retaining property and administratively doling it out after 30 days if the department is not sued, or suing cash, automobiles, and homes as if they are not the private property of a citizen is the stuff of tyranny, pure and simple. It doesn't matter how much easier it makes somebody's job, it's still flat wrong and most certainly not what our founding fathers envisioned when they wrote the fourth amendment.

And what we're talking about here is NOT LE seizing stuff illegally...this is apparently legal (as it stands now), and we think it shouldn't be. Apparently a lot of jurisdictions do it as a money-gathering operation and it just is not right, IMHO. THAT is what we are trying to have a discussion about...not accusing all LE of being bad, corrupt, thieves, or whatever.

I didn't see your opinion on the issue at hand (the constitutionality of the practice of LE seizing of cash during a traffic stop sans arrest). Did I miss it?
