Oh no!! Two of my favorite people having bad things happen is not good. Sadie, remember when one door closes another one opens. Sometimes what we think is "bad" actually turns out to be a blessing in disguise. :hug and :pray for you and your sweet family.

BB, I just don't know what to say. What a sad and tragic way for you and your hubby to spend New Year's Eve. On a more positive note, it was the end of a very trying year. The new year has better things to come. :hug and :pray to you and your hubby, too.
 
I'm always grateful when it isn't me or my family going through difficult times but darn it all, it's no good when it is friends either. :( :( :(

Yes July is more than 60 days ya silly BUt We had a 3 year lease so I would still have another year left after that

they will be putting the house on the market in March or April

It depends on the terms in the lease. I always had a clause in the lease that would let me sell with 30 days notice. Never let a tenent control your property.

This is the way the lease is on my rental house. The party of the first part (I am the landlord) can terminate the lease at any time with 30 days notice. They can only terminate the lease at the end of the lease period, which is a year, with 30 days notice

Signing a lease, as a renter, is the most one way document you will ever sign.

You might want to talk to an attorney on that, as it may not comply with Ga Real Estate Law.
 
Sadie, talk to a Real Estate ATTORNEY as soon as you can so you know your rights. It is unlawful for a real estate agent to comment on this....unless they are also a licensed Attorney. There are a LOT of misconceptions (I've seen a few in this topic) that go around when these situations happen. Don't panic as new federal laws are on your side to protect you, but you still need to know your rights in this legal matter.
 
Short of making this thread sound like the other site....

Why would she want an Attorney? To enforce a lease on a rental house she doesn't want? Sue the owners? It would be a waste of time and money.

I was just going by what my agent told me. Really how can I make a tenant do showings? It's not like they would rush to clean and make it look nice...And in this market, I wouldn't bother selling my house. I would lose way too much money, I would rather keep it and let a tenant pay my mortgage.

To the OP, I would ask the owner to provide you with a bank statement so you can see that they are up to date on paying their mortgage. Sounds to me they are going to do a short sale, I can’t see anyone making or even breaking even on a house in GA..Unless they bought it 10+ years ago. My tenant wants me to show it her at least 2 times a year, I have no problem doing it.

I've had 2 renters break their lease and walk away, it is not worth going after them for the $$$$$. It would cost me to much. You keep their deposit and get someone else in there ASAP.

I cannot get into this too much as it's considered practicing law with out a license, which could cause me to loose my real estate license. A renter has certain rights granted by state and federal law that many people do not know about or understand. This is a legal matter and can only be discussed with an attorney.

And Sadie, moving out without you knowing all the legal issues could get you in bigger trouble, the landlord has rights also that they can go after you with. Consult an attorney ASAP, I cannot stress this enough!
