Who defines the "spirit of the law"? Trump? Republicans? Democrats?

IMO... this is WHY we need to study:
First the founding documents...
Then the INTENTIONS of the writers...
ONLY after we understand both...
Will we understand the SPIRIT of the law.

Examples:
The first amendment does not give someone the right to yell 'FIRE' in a crowded building...
And the second amendment IS to keep govt at bay... it has nothing to do with hunting.

Understand both of those... and we have a start... grin
 
Above... GD and FW speak to the facts and rules we live under and with...

IMO this hollering about this being a Constitutional issue...
Is smoke from the left...
The VERY party that violates the founding documents daily, if not more often.

I will repeat this...
Each of us should study the founding documents...
So we KNOW what is in them... and we KNOW what is within the power of each level and part of govt.
Without that knowledge... we are dependent on a corrupt media or a floating definition website (wikipedia) to tell us what is right and wrong...
IMO a scary situation!

And NO, we do not need to pass a new law, so we can find out what is in it... :D
 
That's probably a bit of an exaggeration.

My 'yes' answer was to the basic question of whether or not POTUS or SCOTUS can do anything if Congress decides to not act on something people want. Clearly POTUS and SCOTUS can act within their allowed authority (I recognize their 'allowed authority' is up for debate) but there isn't much they can do to get rid of a bad Congress. That's what voting is for.

This was the point I was trying to bring forth. The three branches of government have an intricate set of checks and balances to keep any one of them from becoming more powerful than either of the others. In the last 30 years there seems to be an ongoing attempt of each of the branches to test their ability to retain their powers in the light of slight changing of powers in the other two. I see this as a playground pushing and shoving match that usually runs its course, where upon the snipping starts all over again. This has gone on from day one, but the current rancor of the Republicans and Democrats has added a new paradigm to the situation, which at this point is an ugly mess.
 
IMO...

The lust for power... is almost as real as the lust for sex and the lust for $$$ (greed)...
IMO we should keep this reality front and center when we evaluate folks that run for public office...
Specifically: those that lust for power... should NEVER be elected!
Rather those that want to serve and fix... should be elected.
Add to that... better IMO to elect successful business folks... and NEVER elect a career polecat without a proven track record of successful business management! After all... management is management... and if a person can successfully run a large business... they probably have the skills to run govt. OTOH... if they do not... then they are probably gonna be the 'lust for power' type (think BHO, AOC, heels up Harris, the recent looser of govr race, etc)... folks we really do NOT want having power over us!
 
So you're saying the Executive branch and the Judicial branch can do nothing if the US Congress decides to have a 2 year drunken orgy while they wait to get voted out of office.
Basically, yes. The three branches of government have three different responsibilities which can not be comendered by any other branch. There is no Constitutional exception for "we don't like what they are doing".
 
Actually... IMO there is a way to 'encourage' responsible behavior in another of the 3 branches of govt...

Publicity

Everyone carefully manages their public image...
Attack the other branch of govt... showing how they are being destructive to the best interests of Americans and America...
And you have a ready made cake dough.... ready to bake during the next campaign.

AS to doing something about it now...
Impeaching a POTUS is difficult...
And impeaching a member of congress... well congress has to do that. Now IMO if enough folks put enough pressure on congress... someone like AOC or Omar may get the boot...
It would be a really messy fight... with lots of negative drama and destructiveness... not sure that would be good for America.
OTOH... maybe it would wake up a few voters... AND... perhaps if it were successful, it would put some healthy fear and caution into the radical followers of the person who was canned.

Regardless...
IMO the remaining congressional term up to the 2020 election... are gonna be full of 'events'... grin!
