Actually the ruling was unanimous. The headline is misleading. Three judges
however opined that at some point they should address the question, but that this was not the case to hear.
The big question is whether or not the "public", that is taxpayers, should support the non-religious activities of a church organization if they support identical programs of secular organizations. The court needs a broader case.
