Unfortunately the rules are no longer followed and more than likely never were. Presidents, top officials, 1%'ers don't play by the same rules as us worker bees. We don't like the hear that, it's a slap in our face, but it's reality. Call it what you want, blame it on whichever party you're against, but the outcome is the same (and likely always will be). When one block is pulled from the wall the whole thing falls down so they're not willing to risk that happening.

Show me an article where Thomas laid out the conditions that have to be met because I can't find one.

§ 600.1 Grounds for appointing a Special Counsel.
The Attorney General, or in cases in which the Attorney General is recused, the Acting Attorney General, will appoint a Special Counsel when he or she determines that criminal investigation of a person or matter is warranted and—

(a) That investigation or prosecution of that person or matter by a United States Attorney's Office or litigating Division of the Department of Justice would present a conflict of interest for the Department or other extraordinary circumstances; and

(b) That under the circumstances, it would be in the public interest to appoint an outside Special Counsel to assume responsibility for the matter.

That law does not apply to the president for official actions. Since a president has immunity for official actions, there is no criminal offense to investigate. This is part of what you are not getting. And if a president does do something that rises to the level of High Crimes and Misdemeanors; only congress has the authority to discipline him.

The SCOTUS decision is no surprise, most constitutional scholars who aren't partisan hacks knew this immunity existed from the beginning.

I said before the president had immunity for his official acts but not unofficial acts. Trump's charges in Atlanta were from actions were not acts within his official capacity as president but as a political candidate. The charges against Trump in NYC were for offenses prior to his being president and those in the documents case after he was president.

Here's a question for you. If Trump were elected and began having military tribunals charging his political enemies for treason, would he be acting in his official capacity as president or not?

Can't hurt to try but this case may be a stretch given that much (all?) of what he is charged with happened after he was POTUS.
 
I suspect more of these cases against Trump will fall apart now that the SCOTUS has reminded us of Constitutional Law. The Democrats are losing bigly.
