Supreme Court Justice Stephen Breyer to retire

He's kinda liberal, but my suspicions are that Biden will try and put a radical on there.

As for Kamala, I suspect the Republicans will buck up at her. WHile only a simple majority is needed to confirm, I think some Dems might not support her too.

Here's the big question: the sitting VP is the president of the senate, so in a tie, they are the tie breaker. If Kamala was nominated and there was a tie, could she vote to confirm herself?

Right, the better choice there for republicans is Kamala. She is much to simple to effectively debate or implore the other justices to change their mind or at least rethink their position. Stacy Abrams on the other hand is a very effective wordsmith,,, but still you are replacing liberal for liberal and the count remains the same.
 
Biden promised to pick a black woman for SCOTUS so that is probably what he will do to help get some sort of win with his base.
 

A shortlist of potential nominees to replace Breyer on the Supreme Court​


We know that his nominee will almost certainly be a woman. In 2020, then-candidate Biden vowed that he would respond to a Supreme Court opening by nominating a Black woman. Dozens of candidates are being talked about, but nearly all of the Court watchers I interviewed for this story have their money on one in particular: Ketanji Brown Jackson.
Jackson, who is 51, fulfills a lot of requirements for the establishment set. She has the same Ivy League credentials as the sitting justices, having earned both her undergraduate and her law degree from Harvard and edited for the Harvard Law Review. She clerked for three federal judges—including Breyer, from 1999 to 2000. If nominated and confirmed, Jackson will follow the same track as Brett Kavanaugh, who also clerked for the justice he ultimately replaced. Also like Kavanaugh—and seven other current and former justices—Jackson would be coming directly from the D.C. Circuit Court of Appeals, the second-most important court in the country after the Supreme Court.

Although Jackson appears to be the leading contender for Breyer’s seat, other candidates will receive serious consideration. Leondra Kruger, an associate justice on the California Supreme Court, is seen as the top choice for Democrats who’d like Biden to pick someone outside the Beltway. Kruger, who clerked for the late Justice John Paul Stevens, argued 12 cases before the U.S. Supreme Court as an assistant to the U.S. solicitor general. In her seven years on the California Supreme Court, she’s been a swing vote, siding with the more conservative justices on several key decisions. She is only 45, which suggests that she could serve on the bench for several decades. But that could also make her appointment seem less urgent to Biden. “The expiration date on Jackson as a SCOTUS nominee is much closer,” David Lat, the founder of the website Above the Law, told me. Biden “can always nominate Kruger for another vacancy” later on.
 
This is absolutely a political manipulation of a SCOTUS judge. There is zero doubt he will be replaced by an uber liberal far far left judge. This tells me a couple of things that might actually work in conservatives favor in the long run. Firstly it shows the left is very scared of the mid-terms and expect to get their collective assess thumped. It shows that the left does not give a damn about this country and will manipulate and desecrate the constitution and founding fathers any chance they get. Ok I understand the right tries to manipulate the SCOTUS appointments according to political leanings of the candidate which is really not exactly what they are supposed to do either. I am sure the timing of SCOTUS retirements are encouraged when the right is in power also so pot meet kettle. Where the left differs and especially in this case is the suddenness and obviousness of Justice Breyer's surprise decision. The timing is in your face coerced retirement to keep a liberal seat on the court. Even this is not the biggest reason I say the left hates this country and are by far way more hypocritical than the right. The left wants power and control period. The left wants rights and concessions far outside of what the constitution guarantees every "CITIZEN" of this country. They do not want equality they want an upper hand and an easy road to success. They do not want equality or justice they want superiority. How in the hell can a POTUS or a party say they are going to appoint a black female to the court before a vetting process or search is conducted to supposedly find the best candidate? How is it any different than saying we are going to appoint a white male to the court no matter what? By the way I have never heard the right say that. I have often said that SCOTUS is the last check and balance against tyranny and communism so I get fervent about the bastardization of the judicial branch. In closing let me admit that although I can be pretty critical of DJT I have always applauded his SCOTUS appointments. It may very well be his legacy.

Nomination is one thing. Confirmation is another. The dems may regret how they dumped on Manchin and Sinema. Any ultra-leftist nomination may not be a shoe in. A regular leftist... who knows. Maybe the Biden pick will do a reverse John Roberts - go in leftward, then lean rightward later.
