Third Degree Murder

I think he will be found guilty. I do think drugs played a big part in his death but the knee on the neck for 9 minutes was completely unnecessary. if I were in law enforcement today I would seriously consider another career. God help or boys and girls in LE.
probably 3rd, depending on the make up of the jury could be 2nd.

He was, third degree murder. But there are plenty who won't accept anything less than 1st degree.

This is about the Derek Chauvin trial, right? I predict he's convicted of second-degree manslaughter and riots begin shortly after.

I tend to say manslaughter but don't necessarily agree with that. I see nothing legally to charge murder but then again I was dumb enough to think O.J. was guilty of murder. The courts of Cali proved me wrong and I have no more faith in the courts of MN. In any case anything short of a public hanging in front of the courthouse will be unacceptable to the hoards of haters. There will be blood.

It should be manslaughter in the third degree. He can not be convicted with premeditated murder, so the first degree is out. Depending on the jury, they will go for the most they can give him to lessen the riots,,, so it'll probably be second degree murder, and possibly lowered on appeal.

Judge says that Waters has given a good reason for any conviction to be overturned in appeal.

******

Once the jury left the courtroom for the day, defense attorney Eric Nelson called for a mistrial, citing immense media exposure, particularly a comment by Democratic U.S. Rep. Maxine Waters over the weekend in which the California Democrat said while in the Twin Cities that protesters should get "more confrontational" if there is no guilty verdict.

"I'll give you that Congresswoman Waters may have given you something on appeal that may result on this whole trial being overturned," Hennepin County District Judge Peter Cahill said, denying the motion while acknowledging that Nelson's concerns were legitimate.

"This goes back to what I've been saying from the beginning," the judge said. "I wish elected officials would stop talking about this case, especially in a manner that is disrespectful to the rule of law and to the judicial branch and our function.

"I think if they want to give their opinions, they should do so in a respectful and in a manner that is consistent with their oath to the Constitution to respect a coequal branch of government. Their failure to do so I think is abhorrent, but I don't think it has prejudiced us with additional material that would prejudice this jury," Cahill said, adding that the jury has been repeatedly told to not to follow the news.
