Ruth Bader Ginsberg said the president is elected to serve four years, not three. She of course was referring to the Republican majority senate refusing to proceed with Obama's nomination to the high court following the death of Justice Scalia. The Dems in Congress echoed her sentiments because they saw it as an opportunity to appoint a liberal to replace Scalia who was a conservative; giving the court a liberal majority.

It was a Democratic majority Senate under the leadership of Harry Reid that resulted in the "nuclear option" in 2013 that made it possible to confirm a judicial appointment with a 52 vote majority rather than the previously needed 60 vote super majority. It's important to note the Democrats had 52 members in the Senate at the time. In 2017, the Senate became a Republican majority holding 52 seats. McConnell made his own "nuclear option" deal with a 52-48 partisan vote to reduce the majority votes needed to 51. The Democrats screamed, "FOUL!!!"

The closest to an election a member of the high court has died was when Justice Roger Taney passed away 27 days before the election. In the VP debate, Harris falsely claimed, "Honest Abe said, 'It’s not the right thing to do. The American people deserve to make the decision about who will be the next president of the United States.'" The reality is Lincoln never said any such thing, as there is no record of such a statement anywhere. The truth is Lincoln did not make a nomination because the Senate was in recess until December. They were in recess so they could concentrate on campaigning. Even if Lincoln had made a nomination that soon before an election, it would have done no good because the Senate would not be back in session until December, after the election. Harris blatantly lied to the American people.

The truth of the matter is this. Had at this moment in time a Democrat was in the WH and the Dems had the majority in the Senate; that president would have submitted a nomination and the Senate would have moved forward with it. The truth is also that the Republican minority would have been screaming that the process should wait until after the election to allow the candidate winning the presidential election to make the nomination. Hypocrisy exist on both sides of the aisle in both houses of Congress, as the Republican majority blocked Obama's election year nominee from a confirmation hearing in 2016 following the death of Justice Scalia who passed away nine months before the election.

The Dems don't care about a potential justice being a Constitutionalist or a textualist. What they care about is a justice who is a liberal and will base their court decisions not necessarily on the law, but instead to enforce Democratic legislation passed into law, even if that law is unconstitutional or partially unconstitutional. You can tell that by their line of questioning during the Barrett confirmation hearing. They pressed her to give a decision on how she would vote on Obamacare and abortion. Barrett gave told them she could not give them an answer as it would be unethical to do so as such legal questions face the high court. The Dems accused her of not being forthright and deceptive. Had the roles been reversed and this was a liberal nominee being asked the same question by the Republicans, the Dems would be furious.

The Dems wanted a nomination to wait until after the election hoping Biden would win so a liberal could be appointed giving the liberals a majority on the high court. This would allow the Democrats to pass unconstitutional laws and have a majority in the court to actually legislate rather decide on the constitutionality of the laws. This is why the Democrats are threatening that if they get the WH and the majority in the Senate, they will pack the court by increasing the number of SCOTUS seats to give them a liberal majority.

The people in this country need to be very afraid of this threat because it's real. An increase of justices of the court with a liberal majority will make it very possible for the Dems to push socialism down our throats having the same results it did in Venezuela. When Chavez did this, the high court there allowed him to have more power. It allowed the court to remove members of that country's legislative body who opposed Chavez. The American people need to be afraid, very afraid of what's coming if we lose the WH and the majority in the Senate.
