This is why we need to be careful who we put on the Supreme court. I agree with Justice Scalia who said the ruling is "staggering" and "absurd." The Citizens of California will be less safe when this happens in my opinion!

He said the high court had repeatedly overruled the 9th Circuit Court of Appeals for ordering the release of individual prisoners. Now, he said, the majority were ordering the release of "46,000 happy-go-lucky felons." He added that "terrible things are sure to happen as a consequence of this outrageous order." Justice Clarence Thomas agreed with him

So sleeping in a gym and having to share a bathroom are cruel and unusual punishment? i understand overcrowding issues, but this is as bad as the ruling that Atlanta doesn't get any water from Lake Lanier. When two classes have rights that are in conflict, one would think that the court would side with those citizens that didn't break the law and wind up in State prison.

Good grief. I slept in a plywood and 2x4" constructed building that was 16'x32' with 7 other people while in Afghanistan. We slept in tents before that. If those type of living conditions are good enough for the men and women serving this country, then put up temporary wood structures and tents in the exercise yards of these prisons should be good enough for felons serving sentences.

Maybe California should put the inmates in a Ritz Carlton - after all we don't want them to have to suffer any consequences.... :tapfoot2
