Pregnant woman loses baby after shooting but not counted among the dead

After the Colorado shooting, a pregnant woman miscarries due to the stress of the incident. Under the state law, Colorado doesn't acknowledge the baby as being a life thus charges will not be added to the loon who committed the crime.

This makes me sad on so many levels.

Colorado laws regarding this question all require that the offender know or should reasonably know that the woman was pregnant. Unfortunately, a mad gunman shooting wildly in a dark crowded theater falls through that crack. It is indeed sad, regardless of when one presumes life starts.
