Georgia Takes First Step in Complying With Federal Health Care Reform

Any thoughts on this? I was hoping Obama care would be found unconstitutional before we started making big changes to comply with it.

A House subcommittee unanimously approved a bill (HB 476) that would create the Georgia Health Exchange Authority, an arm of state government that would run a state-based insurance exchange -- a central part of the nation's new health care law.

They are still participating in the fight on the Constitutional issues of the federal health care reform, but also preparing if the matter hasn't been heard by the SCOTUS before 2014.

From your article.

Georgia is moving forward with plans for a state-run exchange while it is also vigorously contesting the constitutionality of the Patient Protection and Affordable Care Act. State legislators know that if the law stands and Georgia doesn't set up its own health insurance exchange, then the federal government would design and run Georgia's marketplace.

"We would much rather see the governor and the legislators here decide what is best for Georgia versus taking a one size fits all exchange from the (U.S.) Department of Health and Human Services," said Kyle M. Jackson, Georgia director of the National Federation of Independent Business.

It HAS been found unconstitutional by Judge Vinson. They're just pretending they didn't hear about it.

Just because one federal judge has ruled that way, doesn't mean the case is far from over. It doesn't repeal the law either. Taking the matter to a federal district court is only the first step in repealing a federal law.

Yes, but he's getting ready to issue an injunction, which will throw a monkey wrench into the works. (Lord willing.) He/they are also working to get it expedited to SCOTUS. I read yesterday that somehow the administration pre-funded a bunch of it, so somehow that will make it all the harder to undo. Great.

You are correct. I think he just put a 7 day stay on implementing his ruling.

Keep in mind that an exchange is also a core concept of the Republican plan. This provides a marketplace opportunity for individuals to shop their coverage. it would also be key to allowing aggregation. If we had to start somewhere, this is the least objectionable way to start. This should be of minimal expense to the state compared to the coming Medicaid mandates.

Of course, I would like to start all over again with s.1099.

The state of Maine is saying Obamacare is too costly for them in the long run. Most likely, their waiver was granted because Obama carried that state in the last election. Four other states were granted waivers as well; Ohio (blue). New Jersey blue), Florida (blue), and Tennessee (red). I think Tennessee's waiver was approved to make the administration look impartial.
